We are not very sure of the position in this Department, but we do not think that the Russians should have it both ways. I am writing therefore to suggest that you should clarify the position with the Ministry of Transport (W.R.I. Branch, C and D Division) before we consider any further approach to the Russians or agree to the course of action proposed by Hong Kong. Such action as may be taken on this particular issue is not likely, we think, to prejudice claims of a similar nature against the Soviet Government, but upon this question and also about procedure in respect of British ships wrecked in Soviet territorial waters, the Ministry of Transport will be better qualified to advise.

I am sending a copy of this letter, together with yours under reference, to the Ministry of Transport, and I enclose a copy of the letter which we have sent to them.
